Enterprises Pty Ltd TERMS AND CONDITIONS AS AT 16th February
2004.
GENERAL
These
terms and conditions govern and apply to the provision of
all discount prices and related services ("Services")
by Shop Rite Enterprise Pty Ltd ABN 41081708769 trading
as Shop Rite which includes Shop Rite's successors and assigns.
SHOP RITE'S COMMITMENT
Shop
Rite's obligation to a user of the Services ("Member")
is to use its reasonable endeavours from its established
database to ascertain and communicate to the Member where
a sound price or "value added" product can be
obtained.NO
other legal relation is created between Shop Rite and the
Member.
NO OBLIGATION FOR MEMBER
The
Member is under NO obligation to acquire any product or
service unless and until the Member contracts with the Retailer
to do so.
NO FEE TO MEMBER
No
fee is charged by Shop Rite to the member for the Services.
However, by using the Services the Member EXPRESSLY ACKNOWLEDGES
that Shop Rite has or will be entering into arrangements
with Retailers which will entitle Shop Rite to receive commissions
or other benefits from Retailers as a result of the referrals
of the Members and the Member's purchase to the Retailer.
Full details of the relevant arrangement are available on
request by the Member to Shop Rite.
LIMITATION OF SHOP RITE'S OBLIGATIONS
By
using the Service, and in consideration of the Services,
the Member also
EXPRESSLY ACKNOWLEDGES AND AGREES that:
a) Shop Rite gives no warranty, representation, guarantee
or other assurance whatsoever (expressed or implied):
as to the relevant product or service to be provided by
the Retailer, its quality, availability or suitability for
any purpose;
concerning the Retailer, its financial, industry or professional
standing or its preparedness to honour its quote;
that the price quoted by the Retailer is available for the
product or service;
b) The Member relies upon its own judgement and enquires
with respect to its contractual relation with the Retailer.
VARIATIONS
Shop
Rite may vary these terms and conditions at any time and
reference in any associated documentation or dealing to "Shop Rite Terms and Conditions" is a reference
to the current "Shop Rite Terms and Conditions."
